Attorney Zachary Andrew McEntyre is a partner in King & Spalding, a global law firm focused on complex commercial litigation. In his practice, Zachary Andrew McEntyre largely represents defendants in consumer class action lawsuits. Question: What is a class action lawsuit? Answer: A class action lawsuit allows many plaintiffs to come together to bring a case against a corporation or another entity. Class action lawsuits are often formed when it would be impractical or too expensive for individuals to pursue legal action on their own. Question: When can a class action lawsuit be filed? Answer: Class action lawsuits are subject to different rules in different states, but they largely follow requirements set out in the Federal Rules of Civil Procedure. Under these rules, class action lawsuits must have too many plaintiffs to name individually. All of these plaintiffs need to have the same specific claim against the entity they are suing. Question: How are members of the class included in legal proceedings? Answer: After a judge certifies a class action suit, all potential members of the suit must be notified of the impending lawsuit. They must be given the option to opt out, and they must be informed if a settlement is reached.
