Legal writing can be found in briefs, memos, written arguments, research papers, and other documents. Whatever the application, legal writers are generally strong fundamental writers who can incorporate legal citations. Close attention to detail is also required, as is a grasp of grammar and writing style. Logical reasoning ability is a skill typically found in good legal writers.

As partner with King & Spalding LLP, Zachary Andrew McEntyre conducts civil litigation in defending corporate clients involved in major class action law suits. Among his many legal responsibilities, Zachary Andrew McEntyre participates in the deposition process for important witnesses. Depositions are taken as part of the pre-trial discovery proceedings, during which lawyers investigate matters germane to the case. When a person undergoes a deposition, it means that they are subject to questions asked by lawyers as part of a legal proceeding. People being deposed are under oath and must answer truthfully, or be subject to either civil or criminal penalties. Depositions differ from trial testimony in that they do not occur in court. For instance, depositions may be conducted at the offices of a law firm. The questions and answers are preserved on transcripts or possibly on audio or video and are admissible in court under certain circumstances, such as when a witness would be unavailable to testify at trial. Specific rules or laws that govern depositions differ depending on the state. For the federal courts, deposition protocols are laid out in the Federal Rules of Civil Procedure. Based in Atlanta, Georgia, Zachary Andrew McEntyre serves as a partner at the law firm of King & Spalding LLP. Focused on class-action defense, Zachary Andrew McEntyre has handled suits for clients in various industries, including consumer finance. In 2017, King & Spalding released a client alert about an arbitration agreements rule issued by the Consumer Financial Protection Bureau (CFPB). The rule was opposed by many US banks and business groups. Proponents argued that the rule made it easier for consumers to join together in class-action suits against financial companies. Opponents argued that the rule would lead to an increase in class-action litigation against financial services firms. Following the corporate pushback, the US Senate, with Vice President Mike Pence voting to break a 50-50 tie, repealed the rule in a vote on October 24. In November, President Donald Trump made the repeal official by signing a resolution passed by both Republican-led houses of Congress under the Congressional Review Act. In signing the resolution, the president nullified the CFPB rule and rejected an appeal to keep it in place. In line with the firm’s practice and clients’ best interests, Zachary Andrew McEntyre moves to have cases against his clients dismissed early on through aggressive motion practice. A motion to dismiss is an application made to the court to dismiss a case. It can be made by any of the parties in the case, whether plaintiff or defendant, on various grounds outlined in the Federal Rules of Civil Procedure. A defendant can file a motion to dismiss on any of the following grounds: - Lack of subject matter jurisdiction. Courts are empowered to only hear and determine matters that fall within their jurisdiction. Therefore, if a court does not have jurisdiction to rule on a particular matter, a defendant can move to dismiss the case based on that ground. - Lack of personal jurisdiction. If a court is not empowered to rule on a matter affecting a defendant because of such reasons as the person’s residency, the defendant can move to have the case dismissed. - Insufficient service of process. Service of summons should be done properly, in accordance to law. If the summons and complaint were not properly served to the defendant or if there is a technical fault in the summons, a defendant can move to have the case dismissed. - Failure to state claim for relief. If a plaintiff fails to state a claim or brings one that is insufficient to establish a cause of action, the defendant can move to have the case dismissed. Attorney Zachary Andrew McEntyre is a partner in King & Spalding, a global law firm focused on complex commercial litigation. In his practice, Zachary Andrew McEntyre largely represents defendants in consumer class action lawsuits. Question: What is a class action lawsuit? Answer: A class action lawsuit allows many plaintiffs to come together to bring a case against a corporation or another entity. Class action lawsuits are often formed when it would be impractical or too expensive for individuals to pursue legal action on their own. Question: When can a class action lawsuit be filed? Answer: Class action lawsuits are subject to different rules in different states, but they largely follow requirements set out in the Federal Rules of Civil Procedure. Under these rules, class action lawsuits must have too many plaintiffs to name individually. All of these plaintiffs need to have the same specific claim against the entity they are suing. Question: How are members of the class included in legal proceedings? Answer: After a judge certifies a class action suit, all potential members of the suit must be notified of the impending lawsuit. They must be given the option to opt out, and they must be informed if a settlement is reached. A graduate of Mercer University Walter F.
