A partner at King & Spalding LLP, Zachary Andrew McEntyre focuses his legal practice on commercial litigation, consumer class action suits, and insurance recovery disputes. Recently named one of Atlanta’s 40 lawyers under 40 On The Rise, Zachary Andrew McEntyre is experienced in preparing and taking witnesses to depositions. Depositions are carried out as part of pre-trial discovery. An attorney who wants to find out more about a specific case may call a witness to a deposition so that he/she makes an oral statement on oath as to the facts of the case. The purpose of a deposition is to uncover what a witness knows and to preserve the testimony in case he/she will not be attending a court hearing because of illness or travel. Depositions are not carried out in the courtrooms but rather in attorneys’ offices in the presence of a court reporter. The attorney asks the witness questions on the facts of the case and the witness responds. The court reporter is required to record the responses word for word. All parties to the suit can attend the deposition. Attorneys in depositions are encouraged to ask open-ended questions so as to bring out as much detail as possible ahead of the trial. They generally have more lee-way in depositions than in court proceedings and can ask both open and close-ended questions. The witness is required to answer truthfully since he/she is under oath. With a focus on home furnishings, the large-scale retail center encompasses 70 stores. In consulting with Orion, the King & Spalding Paris office provided assistance in complex corporate law and real estate aspects of the transaction. Also in early 2017, King & Spalding provided consultation to the advisory firm Northwood Investors on its sale of Foncière NW, a portfolio fund encompassing holdings of several French business parks. One of the most common forms of litigation Zachary Andrew McEntyre deals with is the class action lawsuit, in which many consumers band together to address a perceived grievance. Class action suits allow individuals too numerous to all come before a single court to seek a judgment. While it only takes one person to start such a suit, the class can be broad, encompassing hundreds or even thousands of potential claimants. Some common types of class action lawsuits include employee discrimination, false advertisement, or product defects. Consumer advocates argue that class actions make it easier for consumers to seek judgments because it can take less time to settle class actions than many individual lawsuits. Others argue that class actions mostly benefit lawyers, not consumers, and unfairly increase litigation expense and exposure for businesses. Having received his JD from the Walter F. George School of Law of Mercer University in Macon, Georgia, Zachary Andrew McEntyre went on to a successful career in law. Every year, the Burton Awards celebrate the work of law students and practicing professionals alike with its Legal Writing Awards. The program selects 30 partners who work at the 1,000 largest US firms and 15 individuals pursuing law degrees to receive these accolades. Based in Atlanta, Georgia, Zachary Andrew McEntyre has served as a partner at the law firm of King & Spalding LLP, for the last 10 years. In this capacity, Zachary Andrew McEntyre primarily focuses his work in the area of complex commercial litigation. In its general form, commercial litigation refers to business legal disputes. Typically, this type of litigation applies to situations in which at least two separate business entities are in a disagreement about property or money matters. One common example of commercial litigation suits is for breaches of contract, which involve real estate sales and mergers and acquisitions. However, this field of law can also include such disputes as business fraud, class action lawsuits, and problems with shareholders. Recently, commercial litigation has become more complex due to a number of increasingly common legal situations. For example, the introduction of multiple legal disciplines into a single suit increases the stakes of each commercial dispute. Similarly, the more parties that become involved with a case, the more risk they run of prolonging the entire process. If each party has its own individual interest in the case, then it makes it more complex to come to a successful and agreeable settlement. Zachary Andrew McEntyre is a partner at King & Spalding LLP. His law practice focuses on complex commercial litigation. Among his many achievements at King & Spalding, Zachary Andrew McEntyre has earned the Burton Award for distinguished legal writing. The Burton Awards for Legal Achievement is an academic, nonprofit organization that recognizes effective legal writing. The Burton Awards were created in 1999, when clear and concise legibility was beginning to trump the more outdated, conventional style of legal prose. Seventeen years later, it is a prestigious honor to receive one of the Burton Awards for Legal Achievement. The prizes largely go to working lawyers, but the Burton Awards also looks to acknowledge promising law students, and more recently, it has begun to honor journalists who report on legal matters. Each year, the award ceremony gains more notoriety as it includes more notable names, such as Tom Brokaw, Ruth Bader-Ginsberg, and others. King & Spalding partner Zachary Andrew McEntyre works on class action lawsuits. Zachary Andrew McEntyre’s past cases include defending an automaker against allegations of brake defects, a high-tech company against claims of Telephone Consumer Protection Act violations, and a healthcare firm against accusations of overcharges. A class action lawsuit occurs when one or more people who feel that they have been wronged sue purportedly on behalf of a larger group. Usually, class action lawsuits are only approved when there are many people affected by a certain issue and it makes more sense try their cases together. Examples of class action lawsuits with news-making settlements include: -a 2005 case in which AOL Time Warner stock investors sued the company for federal securities fraud, resulting in a $2.5 billion settlement -a silicone breast implant case in 1994 in which women claimed they suffered from autoimmune diseases because of their implants, resulting in Corning, Baxter, and Bristol-Meyers Squibb/MEC settling for $3.4 billion -a 2001 case involving the Exxon Valdez oil spill that affected thousands of people and an extensive expanse of coastline, which ended in a $500 million settlement with Exxon Mobile. |
